Descriere: In the first half of 2024, Romanians filed close to 1,900 applications for negotiation with banks and NBFIs. This means 20% more than in the first half of 2023. The number of negotiation cases (applications accepted by banks) reached 524, going up by 24% compared to H1 2023. The increase is even higher for resolutions (+31%). In 444 cases, the consumers came to terms with their banks, after both sides accepted the solution proposed by conciliators. The decrease in the number of direct settlements (172 such cases/H1 2024 vs 290 such cases at the end of H1 2023) and the increase in the number of negotiation cases shows that, in the first half of this year, banks preferred to address more issued raised by their customers via ABDRC, rather than inviting them to the bank for a direct settlement. The statistical data shows that the number of consumers who approached ABDRC in Q1 2023 observed a slight increase (approximately 23%) compared to Q1 2022. If we are to relate to the cases solved (with resolutions or with amicable settlement further to a referral to ABDRC), the results at the end of Q1 of this year are 20% better than in the same period of last year, with increase in both the number of cases formed, and the number of direct amicable settlements between the parties (having first approached ABDRC). During the 7 years o operation, ABDRC has proven that this new paradigm – an alternative way of resolving disputes – is a win-win approach for both consumers and traders. The possibility that both parties can be involved in changing certain given characteristics of a contractual framework is the starting point for a shift of mindset about the banking contracts/services, at the level of society. Thus, parties can understand one another and forge a trust-based relationship, this being in fact one of the key takes-away/benefits that the ADR procedures have brought along in time, and the facts and figures only come to strengthen this idea: since its establishment, in more than 2,550 cases, parties reached an agreement with the aid and facilitation of one of the ABDRC’s conciliators. Another 1.500 amicable settlements further to consumers having firsts referred the matter to the Banking ADR Centre should be added to this number. (more…)

In the first 9 months, the banks observed the lowest ever percentage of rejected applications, and the highest ever number of direct settlements. Thus, the applications unreasonably rejected accounted for 4.7% of the total applications, whereas the number of direct settlements (after the matter having been first referred to ABDRC) has tripled compared to the similar period of 2021. Thus, during the first three quarters of this year, as many as 823 consumers went through the entire conciliation process (application filing, negotiation, final resolution – a solution accepted by both parties), or reached an amicable settlement directly with banks/NBFIs, having first approached ABDRC. The situation is better than in 2021 (up by 85%) when, during the same period, 445 Romanians were reported in one of these two situations. In the first three quarters of the year, 102 court cases were terminated because the parties wanted, and managed, to find an amicable solution with the help of ABDRC. (more…)
