A consumer from Bucharest obtained close to EUR 39,000 following the negotiations with the bank. Further to application of the ABDRC procedure, he will no longer be charged the management fee of EUR 35,000, and additionally, he was returned the financing fee of EUR 3,770.<\/p>\n

<\/p>\n The Alternative Banking Dispute Resolution Centre (ABDRC) resolved the biggest case in terms of value. <\/strong><\/p>\n A consumer from Bucharest obtained close to EUR 39,000 following the negotiations with the bank. Further to application of the ABDRC procedure, he will no longer be charged the management fee of EUR 35,000, and additionally, he was returned the financing fee of EUR 3,770.<\/p>\n Thus, the cost of the loan for this consumer was reduced by EUR 38,770.<\/strong><\/p>\n \u201c<\/em>So far, the highest amount a consumer has benefited of was EUR 20,000 and it was a social case; now, we speak of a case with almost double benefits, value wise. The increasing amounts subtracted by the financial and banking institutions from the principal or the cost of loans stand proof of the fact that banks are genuinely willing to negotiate better conditions for consumers in order to continue their contractual relations, and to settle disputes amicably, and not in court<\/em>\u201c, said Alexandru P\u0103unescu, member of the Steering Board of ABDRC.<\/strong><\/p>\n How the negotiation unfolded<\/strong><\/p>\n The solution proposed by our conciliator Marieta Avram, after three months <\/strong>of discussions with both parties involved, i.e.<\/em> the bank and the consumer.<\/p>\n \u201c<\/em>It is a special case considering the high amount of the loan and the fact that this consumer did not fall into the scope of the datio in solutum law, which means that, in legal terms, this consumer had no other alternatives than negotiation. Nevertheless, because this loan had been granted for a very long period of time, the solution proposed was to address only some of the claims in this stage.
