Thus, so far, the reports for the quarters ended on the following dates have been drawn up and posted on our website: 30.06.2016, 30.09.2016, 31.12.2016 (annual report), and as at 31.03.2017.<br \/>\n<!--more--><\/p>\n<p><strong>In the first 6 months of 2017, the following were registered:<\/strong><\/p>\n<ul>\n<li>(approximately) 4,300 consumer requests by phone;<\/li>\n<li>416 written applications:\n<ul>\n<li>162 of the written applications were found compliant;<\/li>\n<li>246 were questions or requests for miscellaneous\/general information to which the Procedural Secretariat replied in writing;<\/li>\n<li>8 non-compliant applications.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Means of filing compliant applications:<\/strong><\/p>\n<ul>\n<li>108 were filed by email;<\/li>\n<li>29 were brought to, and registered by consumers with the office of ABDRC.<\/li>\n<li>25 were mailed by consumers.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Qualification of the 162 compliant applications:<\/strong><\/p>\n<ul>\n<li>39 turned into casefiles (2 casefiles were consolidated; 5 casefiles formed this year come from applications filed in the end of last year);<\/li>\n<li>23 in screening phase (review of documents);<\/li>\n<li>105 closed;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Breakdown of the 38 casefiles managed under the conciliation procedure:<\/strong><\/p>\n<ul>\n<li>15 resolutions rendered;<\/li>\n<li>7 reports issued;<\/li>\n<li>5 preliminary casefiles;<\/li>\n<li>9 casefiles in phase of discussions\/meetings with the parties;<\/li>\n<li>1 inadmissibility resolution;<\/li>\n<li>1 casefile in which the trader withdrew from the procedure.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>NOTE:<\/strong><\/p>\n<p>Both the interest and awareness of the consumers of ABDRC have raised compared to last year. The results of the first 6 months of 2017 are better than for the entire 2016, according to the figure compared:<\/p>\n<p>In 10 months of operation in 2016 (March &#8211; December), the following were registered:<\/p>\n<ul>\n<li>235 compliant applications \u2013 23.5 applications per month;<\/li>\n<li>46 casefiles \u2013 4.6 casefiles per month;<\/li>\n<li>26 non-compliant applications \u2013 2.6\/month.<\/li>\n<\/ul>\n<p>In the first 6 months of 2017, the following were registered:<\/p>\n<ul>\n<li>162 applications \u2013 27 applications per month;<\/li>\n<li>38 casefiles \u2013 6.33 casefiles per month;<\/li>\n<li>8 non-compliant applications \u2013 1.33\/month.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>The applications received from consumers targeted the following types of claims:<\/strong><\/p>\n<ul>\n<li>return of the risk fee charged for a loan;<\/li>\n<li>loan rescheduling\/staging out;<\/li>\n<li>reduction of the monthly instalments, when the consumer assesses that the monthly instalments have been abusively increased by the trader;<\/li>\n<li>return of the management fee, the monitoring fee or other categories of fees &#8211; perceived by consumers as unlawfully charged;<\/li>\n<li>return of the amount resulted from the excessive increase in the interest rate, as perceived by consumers;<\/li>\n<li>reduction of the interest rate, and freezing of exchange rate at the rate applied at execution of the loan agreement (in CHF);<\/li>\n<li>defaults of the contractual conditions by traders, leading to declaration of the loan early repayable;<\/li>\n<li>calculation and payment of the instalments in RON, at the rate of exchange applied at the time when the agreement was concluded;<\/li>\n<li>removal of clauses qualified by consumers as abusive, as regards application of default interests;<\/li>\n<li>deregistration of entries in the Credit Register, etc.<\/li>\n<\/ul>\n<p><strong>The main reasons for closing compliant applications, as claimed by traders:<\/strong><\/p>\n<ul>\n<li>traders do not belong to the category of those the business of which is regulated by the National Bank of Romania pursuant to the Government Ordinance no. 38\/2015 (assigned claims);<\/li>\n<li>claimants are not consumers, as defined in the Government Ordinance no. 21\/1992;<\/li>\n<li>the trader refused resolution of the dispute under ADR procedures for the following reasons:\n<ul>\n<li>pending court proceedings where a final solution\/court judgment is expected;<\/li>\n<li>all settlement efforts have already been exhausted (in the trader\u2019s opinion);<\/li>\n<li>the agreement observes the legal provisions (in the trader\u2019s opinion);<\/li>\n<li>amicable settlement between the consumer and the trader is being attempted;<\/li>\n<li>several offers were made, but all have been turned down by the consumer (before approaching ABDRC);<\/li>\n<li>forced execution procedures have already been initiated;<\/li>\n<li>lack of substance (claimed by the trader) for the consumer\u2019s application;<\/li>\n<\/ul>\n<\/li>\n<li>no reasons provided.<\/li>\n<\/ul>\n<p class=\"p1\">\n<div class=\"buton-descarca\"><a class=\"za-btn custom-font-7 animate_icon\" href=\"https:\/\/csalb.ro\/wp-content\/uploads\/2018\/03\/Raport_CSALB_30_06_2017_dtp_EN_f.pdf\" target=\"_self\" style=\" font-size:11px;  letter-spacing:2px;  padding-top:10px; padding-bottom:10px;  padding-right:20px;  padding-left:20px;  border:2px solid #ee7f01;  border-radius: 0px; -webkit-border-radius: 0px; -moz-border-radius: 0px; -o-border-radius: 0px;  color: #ee7f01;  background-color: #ffffff; \" onmouseover=\" this.style.color='#f5ca89'; this.style.backgroundColor='#333333'; this.style.borderColor='#333333';\" onmouseout=\" this.style.borderColor='#ee7f01'; this.style.color='#ee7f01'; this.style.backgroundColor='#ffffff';\"><span class=\"button-text\"><span class=\"icon\"><i class=\"fa fa-download\"><\/i><\/span>Download<\/span><\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>As of mid-last year, ABDRC has reported on its work in the end of each quarter.
