{"id":15013,"date":"2025-10-31T14:12:43","date_gmt":"2025-10-31T12:12:43","guid":{"rendered":"https:\/\/csalb.ro\/?p=15013"},"modified":"2025-10-31T14:12:43","modified_gmt":"2025-10-31T12:12:43","slug":"report-on-alternative-dispute-resolution-as-at-30-09-2025","status":"publish","type":"post","link":"https:\/\/csalb.ro\/en\/rapoarte-csalb\/report-on-alternative-dispute-resolution-as-at-30-09-2025\/","title":{"rendered":"REPORT ON ALTERNATIVE DISPUTE RESOLUTION AS AT 30.09.2025"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text]<strong>During the first nine months of 2025, as many as 812 consumers went through the entire conciliation process: application filing, negotiation, final resolution <\/strong><strong>\u00f3<\/strong><strong> a solution accepted by both parties (in 595 cases), or reached an amicable settlement directly with their banks\/NBFIs, having first approached ABDRC (in 217 cases).<\/strong><\/p>\n<p><strong>In the first nine months of the year, 89 court cases were terminated because the parties wanted and managed to find an amicable solution with the help of ABDRC.<\/strong><\/p>\n<p>The number of compliant applications registered in the first nine months of the year stands at <strong>2,121 applications, <\/strong>with both the number of applications to banks and the number of applications to NBFIs lower this year compared to the same period last year, amid a decrease in the volume of requests for de-registration from the Credit Bureau. Some consumers continued to experience genuine difficulties in making the due payments, and these justified circumstances required identification of solutions to rebalance the contractual obligations (with the applications being submitted directly to creditors, or via ABDRC).<\/p>\n<p><strong>Of the total number of applications received before the end of Q3 2025, <\/strong>1,620 concerned different issues in relation with banks, whereas 501 concerned different issues in relation with NBFIs.<\/p>\n<p>Thus, <strong>the share of applications to NBFIs fell below last year&#8217;s reference period: <\/strong>from 26.6% of total\/Q3 2024 down to 23.6% of total\/Q3 2025.<\/p>\n<p>Aggregately, <strong>the share of applications intended at banks increased compared to last year&#8217;s reference period:<\/strong> 73.4% of the total\/at the end of Q3 2024, and 76.4% of the total\/Q3 2025.<\/p>\n<p>At the end of Q3 2025, we see 500 <strong>applications for deregistration from the Credit Bureau (CB) <\/strong>(282 intended at banks + 218 intended at NBFIs), while the number of this type of applications recorded <strong>at the end of Q3 2024 was 803<\/strong>. Thus, in this statistical slot, we need to highlight also that, in the first nine months of this year, <strong>the number applications for deregistration from the Credit Bureau (CB) stayed flat compared to last year (a decrease by approximately 38%).<\/strong><\/p>\n<p><strong>It should be reminded that most of the applications concerning issues in relation to the Credit Bureau, the First Home programme or assigned loans are closed<\/strong> because, on a case-by-case basis, these are governed by a special piece of legislation which leaves but limited or even no room whatsoever for negotiation.<\/p>\n<p><strong>The number of casefiles formed at the end of Q3 2025 reached 686. Two casefiles were formed in relation to a NBFI and 684 were<\/strong> formed in relation to banks. By way of comparison, 825 casefiles were formed in the first nine months of 2024 (one single casefile in relation to NBFIs). Of the casefiles formed this year and settled until the end of the reference period, 595 concluded with a resolution (the parties accepted the solution proposed by the conciliator), while other 60 casefiles are still being processed (at the end of Q3 2025). In 20 cases, one of the parties rejected the solution rendered by the conciliator and a report was issued, whereas in 11 cases, one of the parties withdrew from the procedure.<\/p>\n<p>The number of resolutions handed down in the first nine months of this year is 595, compared to the figure reported for the same period of last year, <em>i.e. <\/em>721 resolutions (<strong>during the two periods under review, being Q3 2025 and Q3 2024, the share of resolutions out of the total solutions is 96% in both years<\/strong>).<\/p>\n<p>Furthermore, before the end of the Q3 2025, <strong>217 applications were settled amicably<\/strong> by traders after the respective cases having been referred to ABDRC (traders negotiated directly with consumers), broken down as follows: <strong>176 applications settled amicably with banks, and 41 applications settled amicably with NBFIs<\/strong>.<\/p>\n<p><strong>At the end of Q3 of this year, <\/strong>we counted 1,318 enquiries made by phone, and 293 persons\/consumers accessed the chat function available on the ABDRC website.<\/p>\n<p>&nbsp;<\/p>\n<h2><strong>A breakdown of the applications by traders looks as follows:<\/strong><\/h2>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>BANKS:<\/strong><\/p>\n<ul>\n<li><strong>1,620<\/strong> compliant applications;<\/li>\n<li><strong>740<\/strong> non-compliant applications;<\/li>\n<li><strong>530<\/strong> requests for miscellaneous information.<\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>Classification of the 1,620 compliant applications<\/strong>:<\/p>\n<ul>\n<li><strong>684<\/strong> casefiles formed in the end of Q3 2025 (at the start of this year, <strong>141<\/strong> casefiles were formed from compliant applications received in late 2024);<\/li>\n<li><strong>199<\/strong> applications in screening phase \u2013 documents are being reviewed;<\/li>\n<li><strong>176<\/strong> applications were settled amicably by the parties, after the consumer having first made a referral to ABDRC;<\/li>\n<li><strong>578<\/strong> cases were closed;<\/li>\n<li><strong>124<\/strong> applications were adjoined.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Classification of the 684 casefiles undergoing the procedure with proposed solution\/conciliation:<\/strong><\/p>\n<ul>\n<li><strong>594<\/strong> resolutions handed down \u2013 the parties came to terms;<\/li>\n<li><strong>60<\/strong> cases in the processing phase;<\/li>\n<li><strong>19<\/strong> reports \u2013 the parties did not come to terms;<\/li>\n<li><strong>11<\/strong> casefiles in which one of the parties withdrew.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Methods of filing compliant applications <\/strong>&#8211; regardless of the referral channel, all compliant applications are entered into the IT application used to manage applications and casefiles:<\/p>\n<ul>\n<li><strong>730<\/strong> were submitted via the app (website);<\/li>\n<li><strong>319<\/strong> were e-mailed;<\/li>\n<li><strong>541<\/strong> were mailed;<\/li>\n<li><strong>30<\/strong> were brought to, and registered by consumers with, the office of ABDRC.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>NBFIs:<\/strong><\/p>\n<ul>\n<li><strong>501<\/strong> compliant applications.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Classification of the 501 compliant applications<\/strong>:<\/p>\n<ul>\n<li><strong>2 <\/strong>casefiles (one casefile formed in 2025 from one application received before the end of 2024);<\/li>\n<li><strong>14<\/strong> applications in the screening phase;<\/li>\n<li><strong>41<\/strong> applications were settled amicably between NBFIs and consumers, after the consumer having first approached ABDRC;<\/li>\n<li><strong>445<\/strong> were closed \u2013 rejected by the NBFIs.<\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>Qualification of the 2 casefiles undergoing the procedure with proposed solution\/conciliation:<\/strong><\/p>\n<ul>\n<li><strong>1<\/strong> resolution rendered \u2013 the parties reached an agreement;<\/li>\n<li><strong>1<\/strong> report \u2013 the parties failed to reach an agreement.<\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>Means of filing compliant applications:<\/strong><\/p>\n<ul>\n<li><strong>447<\/strong> were submitted via the app (website);<\/li>\n<li><strong>45<\/strong> were emailed;<\/li>\n<li><strong>5<\/strong> were mailed;<\/li>\n<li><strong>4<\/strong> were brought to, and registered by the consumer at, the office of ABDRC.<\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<h2><strong>The applications received from consumers covered the following topics:<\/strong><\/h2>\n<ul>\n<li><strong>Problems in connection with credit products:<\/strong><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Refunds (of fees\/commissions, interest);<\/li>\n<li>Shift from ROBOR to IRCC;<\/li>\n<li>Reduction of loan principal\/debt\/instalment, or writing off overdue amounts;<\/li>\n<li>Rescheduling\/refinancing\/staging-out;<\/li>\n<li>Agreement renegotiation\/rebalancing <strong>(including for hardship<\/strong>);<\/li>\n<li>Finding a solution to address the problems (in general);<\/li>\n<li>Conversion of the loan currency;<\/li>\n<li>Problems with insurance policies (bancassurance);<\/li>\n<li>Interest recalculation;<\/li>\n<li>Payment commitments;<\/li>\n<li>Maturity acceleration;<\/li>\n<li>Removal of certain clauses;<\/li>\n<li>Credit Bureau (deregistration from CB).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Operational problems:<\/strong><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Problems with operation of the ATMs (including refunds);<\/li>\n<li>Problems in connection with wire transfers and refunds of transaction fees;<\/li>\n<li>Refunds in case of processing errors;<\/li>\n<li>Recovery of amount wrongly transferred by consumers (internet banking);<\/li>\n<li>Provision of clarifications about calculation of the amounts withdrawn by banks from the credit card account;<\/li>\n<li>Other card-related problems (cancellation\/name change);<\/li>\n<li>Problems in connection with the exchange rate and interests charged when using the cards abroad;<\/li>\n<li>Problems regarding inter-banking transfers.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Problems related to other types of activities:<\/strong><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Problems in connection with forced execution (suspensions\/stays of proceedings);<\/li>\n<li>Requests to be issued documents (repayment schedules, statements of account, etc.);<\/li>\n<li>Refunds of garnished amounts;<\/li>\n<li>Mortgage deregistration;<\/li>\n<li>Fraud committed via bank channels.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The main reason for closing an application is the refusal of traders to have the dispute settle via ADR procedure, and the reasons for closing fall into several categories:<\/p>\n<ul>\n<li><strong>Good reasons (main) \u2013 the application concerns:<\/strong>\n<ul>\n<li>deregistration of entries from the Credit Bureau;<\/li>\n<li>\u201cFirst Home\u201d loans;<\/li>\n<li>claim assigned to companies which are not regulated by the National Bank of Romania;<\/li>\n<li>the state premium under saving-credit contracts.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Reasons related to consumers:<\/strong>\n<ul>\n<li>selection of a trader the business of which is not regulated by the National Bank of Romania;<\/li>\n<li>selection of a trader they don&#8217;t have commercial relations with;<\/li>\n<li>the information\/documents required for resolving the application have not been supplied;<\/li>\n<li>the consumer does not reply within 90 days;<\/li>\n<li>the consumer withdraws.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Other reasons:<\/strong>\n<ul>\n<li>pending court proceedings;<\/li>\n<li>forced execution procedures have already been initiated;<\/li>\n<li>traders made several offers, but all of them were turned down by consumers (before approaching ABDRC), and traders maintain their point of view in the initial answer sent to consumers;<\/li>\n<li>lack of grounds (claimed by the trader).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><strong>&nbsp;<\/strong><\/p>\n<h2><strong>BENCHMARKING:<\/strong><\/h2>\n<table width=\"700\">\n<tbody>\n<tr>\n<td <\/u><\/strong><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li>Since the start of the year, ABDRC has been running an <strong>awareness, financial education and communication campaign<\/strong> involving commercial banks, journalists and ABDRC conciliators. Over the recent years, more and more people are finding out about ABDRC\u2019s existence and work from the Centre&#8217;s communication and awareness campaigns.<\/li>\n<li>ABDRC continues the production of the <strong>fifth season of the ABDRC Podcasts.<\/strong> The <strong>financial education podcasts<\/strong> hosted by the Centre are attended by specialists in the areas covered by discussions, credit brokers, court bailiffs, representatives\/specialists of commercial banks, the Romanian Association of Banks (RAB) and the National Bank of Romania (NBR), and ABDRC conciliators. The debates are moderated by financial analysts, financial education specialists and top business journalists.<\/li>\n<li><strong>Season 5 podcasts<\/strong> address topics inspired by the types bank negotiation applications that consumers file with ABDRC. These topics cover: cards and payments; bank loans; bank fraud; foreclosures; Artificial Intelligence (AI); court proceedings versus alternative dispute resolution, etc.<\/li>\n<li>Each podcast broadcast is accompanied by a three-week <strong>promotional campaign<\/strong> that includes: press release, video and text ads on csalb.ro, social media channels (Facebook, Instagram, LinkedIn, TikTok, YouTube), and through media partners (TV channels, radio, online media, local media, blogposts).<\/li>\n<li>Another way of informing consumers is the <strong>ABDRC newsletter<\/strong> sent out to consumers of financial services who subscribed to receive this information. A new page was created on the csalb.ro website to allow consumers to sign up for the ABDRC Newsletters.<\/li>\n<li>ABDRC has produced and distributed to commercial banks more than <strong>100,000 information flyers, <\/strong>on which consumers can directly fill in an application to negotiate with the bank.<\/li>\n<li>In early 2025, ABDRC held its <strong>annual press conference <\/strong>attended by conciliators, members of the Steering Board, and TV, radio and written press journalists.<\/li>\n<li>The csalb.ro website has a <strong>section dedicated to financial education<\/strong>, where one can find narrative and video information that consumers can rely on to make their financial decisions.<\/li>\n<li><strong>Via its call-centre<\/strong>, ABDRC contacts consumers who want this (having agreed to this in various social media campaigns) by phone. They receive information about an alternative procedure to settle their disputes with banks\/NBFIs.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong><u>CONCLUSIONS<\/u><\/strong><strong>:<\/strong><\/h2>\n<p>The ABDRC services continue to be accessed by the Romanians who have problems with banks\/NBFIs. Benefits of conciliation: the court proceedings are avoided and the contractual relations between parties continue; short case settlement time (an average of approximately one month over the last years, and of 15 days in 2024); the fact that the procedure is free of charge for consumers, added to the expertise of conciliators, are all important benefits for both consumers and the financial and banking institutions involved in these negotiations, particularly during economically difficult times, the effects of the pervasive rise in prices due to the unfavourable economic and political international context still being present. In this context, <strong>the conclusions drawn for the first nine months of 2025<\/strong> are as follows:<\/p>\n<ul>\n<li>During the first nine months of 2025, Romanians filed 2,121 applications for negotiation with banks and NBFIs.<\/li>\n<li>The share of applications intended at banks (out of total) went up from 73.4%\/Q3 2024 to 76.4%\/Q3 2025.<\/li>\n<li>While the total number of applications <strong>fell in Q3 2025, we saw an increase in negotiable applications out of total applications. Thus, the share of negotiable applications out of total applications\/Q3 2025 is 76.5%, compared to the share of negotiable applications in the same period last year\/Q3 2024, which is 71.8%. <\/strong>This is due to a drop from 803 (in Q3 2024) down to 500 (in Q3 2025) in the number of applications for deregistration from the Credit Bureau (which cannot be negotiated via ABDRC, but are settled directly by the parties or are closed).
